Class Pass — Annex to the General Terms and Conditions
This Annex forms part of the General Terms and Conditions of Mandy's Jump & Smile (the "Provider") and applies to every Class Pass bought through this website.
1. Subject matter
1.1 A Class Pass is a prepaid entitlement to a fixed number of classes at a single venue operated by the Provider, purchased in advance through the Provider's website.
1.2 The Pass currently offered comprises eleven (11) classes at the venue named at the time of purchase, of which ten (10) are paid for and one (1) is supplied free of charge. The number of classes, the price and the period of validity applicable to a given Pass are those displayed on the website at the moment of purchase.
1.3 A Pass confers a right to book classes subject to availability. It does not reserve any class, date or place, and does not guarantee that classes will be scheduled at any particular frequency.
2. Formation of the contract
2.1 The contract is concluded when the Provider confirms receipt of payment. Until payment is confirmed the Pass confers no entitlement.
2.2 The purchaser receives confirmation by email, stating the reference of the Pass, the venue, the number of classes and the date on which the Pass expires.
3. Personal nature
3.1 A Pass is personal to the purchaser. It may not be sold, transferred, assigned or otherwise made available to any other person.
3.2 One class is deducted per booking, for the purchaser alone. A Pass may not be used to book a place for another person, nor more than one place in the same class.
4. Period of validity
4.1 A Pass is valid for twelve (12) months from the date on which payment is confirmed.
4.2 A class must take place within the period of validity. It is not possible to use a Pass to book a class scheduled after its expiry date, even where the booking itself is made before that date.
4.3 Classes not used before expiry lapse, subject to Articles 8 and 9.
4.4 No classes are held during the school holidays, nor during any other break shown in the published timetable. Such breaks are known when a Pass is purchased; they fall within the period of validity and do not extend it.
4.5 Where, for a reason other than a break under Article 4.4, no class is held at the venue named on the Pass for more than four (4) consecutive weeks, the period of validity is extended by the length of that interruption. The Provider informs the purchaser of the new expiry date by email.
5. Use of the Pass
5.1 Classes are booked through the Provider's website in the ordinary way. Where the purchaser holds a valid Pass for the venue concerned, one class is deducted automatically and no further payment is due for that booking.
5.2 The purchaser may decline to use the Pass for a given booking and pay for that class separately.
5.3 Where the purchaser holds more than one valid Pass, the Pass expiring soonest is used first.
5.4 The Provider records, and makes available to the purchaser at any time, the classes deducted from the Pass, the date of each, and any class credited back under Article 6.
6. Classes credited back
6.1 A class is credited back to the Pass where:
(a) the purchaser cancels the booking within the period stated in the Cancellation Policy; or
(b) the Provider cancels the class, or the purchaser's place in it, for any reason other than those stated in Articles 11 and 12.
6.2 A class credited back is available for further use until the Pass expires. Crediting back does not extend the period of validity.
7. Non-attendance and late cancellation
7.1 A class is not credited back where the purchaser does not attend, or cancels after the period stated in the Cancellation Policy has expired. The class is treated as used.
7.2 This applies in the same way as it does to a class paid for individually.
8. Right of withdrawal
8.1 Where the purchaser is a consumer, the purchase of a Pass is a distance contract. The purchaser has a period of fourteen (14) days from the conclusion of the contract in which to withdraw, without giving any reason and without penalty, in accordance with the Luxembourg Code de la consommation transposing Directive 2011/83/EU.
8.2 Withdrawal is exercised by any unequivocal statement to the Provider at info@mandysjumpandsmile.lu before the period expires.
8.3 Where the purchaser has used one or more classes during the withdrawal period, the Provider is entitled to retain an amount proportionate to the classes used, calculated by reference to the total price of the Pass and the total number of classes it comprises.
8.4 The Provider reimburses the balance without undue delay, and in any event within fourteen (14) days of being informed of the withdrawal, using the same means of payment as the original transaction.
9. Termination and reimbursement outside the withdrawal period
9.1 Where the Provider permanently ceases to offer classes at the venue named on the Pass before it expires, the purchaser is entitled to reimbursement of the classes not yet used, calculated as under Article 8.3.
9.2 Save as provided in Articles 8 and 9, a Pass is not reimbursable.
10. Changes
10.1 A change to the price, the number of classes or the period of validity of a Pass applies only to Passes purchased after the change takes effect. It has no effect on a Pass already held.
10.2 The Provider may amend this Annex for future purchases. The version applicable to a Pass is the version in force at the time it was purchased.
11. Misuse of the Pass
11.1 Where a Pass is used in breach of Article 3, or has been obtained by fraudulent means, the Provider may refuse the person concerned admission to the class. The class booked with the Pass is treated as used.
11.2 The Provider may in addition cancel the Pass.
11.3 Classes already taken remain taken and the corresponding bookings remain valid.
12. Exclusion from a class
12.1 The Provider may exclude a participant from a class, or refuse them admission to it, where the participant:
(a) behaves in a manner that is aggressive, offensive or otherwise inappropriate towards the Provider or other participants;
(b) disregards the Provider's safety instructions or the rules of the venue;
(c) takes part, or attempts to take part, under the influence of alcohol or drugs; or
(d) by their conduct causes other participants to feel unsafe or uncomfortable.
12.2 A class from which a participant is excluded under Article 12.1 is treated as used.
12.3 Where the conduct is serious, or is repeated after a warning, the Provider may cancel the Pass.
13. General
13.1 The remaining provisions of the General Terms and Conditions, the Cancellation Policy and the Privacy Policy apply to Passes.
13.2 In the event of a conflict between this Annex and the General Terms and Conditions in respect of a Pass, this Annex prevails.
